If: (a) the Purchaser accepts the Seller's Quote (where the Quote is in composing, by performing it); or (b) the Seller accepts the Purchaser's Order, a contract is produced between the parties whereby the Seller offers to the Buyer the Product on these conditions. 5. After creation of the contract the order for the Product can just be cancelled by the Buyer if the Seller authorizations to the cancellation and the Buyer repays the Seller for all costs associated with the work undertaken in relation to the agreement and also pays the Seller a quantity equivalent to the earnings which the Seller would have achieved had the agreement been completed.
6. If the Seller, at any time consisting of after creation of the agreement, thinks about the credit of the Purchaser unacceptable the Seller may: (a) need security for payment of the Purchase Rate. At our option, we might supply surplus materials as a safety measure against damage or loss. On conclusion of the agreement any surplus products will remain the property of Flex Physical fitness Equipment and will be promptly eliminated from site. 12 (Personal Trainer in Aveley Western Australia). The arrangement of labour and a suitable forklift for the unloading of our materials and handling on to the erection website and/or covered storage area is the responsibility of the buyer, unless otherwise agreed in composing.
13. Where our materials are kept on site for any factor whatever in between the time of shipment and the start of setup, the care and defense of such products is the sole duty of the purchaser (Gym in Sorrento ). Where the storage is at an area remote from the installation site, transfer of our materials to site is the obligation of the buyer.
14. If the Purchaser requires unique packaging in relation to the Item it must be accepted in writing in between the Purchaser and the Seller, and the expense of the same is to the Purchaser's account and appropriately will be consisted of in the Purchase Price. If the Seller stops working to include the expense of special packaging in the Purchase Rate the Purchaser must pay to the Seller such expenses as needed.
Where installation is consisted of in the agreement the arrangement of a clear working site and adequate gain access to will be the responsibility of the buyer. However, if the flooring piece is reinforced with grid steel mesh or comparable materials to a level less than 70 mm listed below the surface area, unique drilling devices will be needed and any extra expenses incurred will be to the purchaser's account.
Unless specified in writing our quotation presumes a sensible condition of flatness of flooring. Flatness tolerances should be within + 3 mm inside a 3 metre radius. Extra expenses incurred in making up for a malfunctioning or uneven floor will be to the purchaser's account. 19. We schedule the right to assign or subcontract out the entire or any part of this contract at our discretion.

21. The Purchaser will pay the Seller instantly. If the Buyer fails to make a payment by the due date, the Seller may, without notification, keep shipment of any further Product to the Buyer and might terminate, without liability to the Purchaser, any or all surviving contracts in between the Seller and the Buyer.
If payment is not made on the due date, the Seller might charge interest on the quantity payable at the rate of 5% over the 90 day bank bill rate applicable on the day the payment is due. 23. The Purchase Price is not inclusive of products and services tax, unless otherwise defined in composing.
